OVERVIEW

Welcome to Altruism Scholars. The terms “we,” “us,” and “our” refer to Altruism Scholars.

Altruism Scholars operates this store and website, including all related information, content, features, tools, products, educational resources, digital materials, subscriptions and services in order to provide customers with imaginative, creative and educational experiences (collectively, the “Services”).

Altruism Scholars is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced herein (“Terms”), describe your rights and responsibilities when you access or use our Services.

Please read these Terms carefully. They contain important information about your legal rights, purchases, subscriptions, intellectual property, warranty disclaimers and limitations of liability.

By visiting, interacting with, purchasing from or otherwise using our Services, you agree to these Terms of Service and our Privacy Policy.

If you do not agree to these Terms or our Privacy Policy, you should not access or use our Services.

SECTION 1: ACCESS AND ACCOUNTS

By agreeing to these Terms, you represent that you are at least the age of majority in your state, province or jurisdiction of residence.

Altruism Scholars products and educational experiences may be designed for children, but purchases, customer accounts, subscriptions and transactions must be completed or authorized by an adult who is legally permitted to enter into the transaction.

Customer accounts and online account features are intended for adult parents, guardians and Mentors. Children are not required or permitted to independently create customer accounts, manage purchases or participate in Mentor only online account features.

A Mentor Account may allow an eligible Mentor to manage information relating to one or more Scholars participating in Learning Adventures. Additional terms regarding Scholar Profiles and information provided for personalization are described below and in our Privacy Policy.

To use certain Services, you may be asked to provide information including your name, email address, billing information, payment information and shipping information. You represent that the information you provide is accurate, current and complete and that you have the right to provide it.

You are responsible for maintaining the security of your account credentials and for activity conducted through your account.

You may not sell, transfer, assign or license your customer account to another person.

SECTION 2: OUR PRODUCTS AND EXPERIENCES

Altruism Scholars offers products and experiences that may include Adventure Kits, sensory materials, creative materials, art supplies, learning resources, digital materials, printables, stories, activities, Mentor resources, subscriptions and other products or experiences.

We make reasonable efforts to accurately represent our products and Services. Colors, textures, packaging, sizing and appearance may vary slightly from what is displayed on your screen due to device settings, photography, manufacturing variations and the handmade or curated nature of certain products.

Product photographs may include props, scenery or decorative items for presentation purposes. Only items identified as included in the applicable product description are included with your purchase.

Certain curated products may occasionally require a reasonable substitution because of supplier availability, discontinuation or other circumstances. When a substitution is necessary, we may replace an item with a reasonably comparable item while seeking to preserve the overall purpose and experience of the product.

Product descriptions, contents, availability and specifications may change without notice.

We reserve the right to discontinue products or limit quantities available to any person, household, geographic region or jurisdiction where permitted by law.

SECTION 3: ADVENTURE KITS

Adventure Kits are physical products designed to encourage imaginative play, creativity, sensory exploration, building, discovery or other hands on experiences.

Specific contents vary by Adventure and are described on the applicable product page.

Adventure Kits and Learning Adventures are separate offerings unless a product listing expressly states otherwise. Purchasing an Adventure Kit does not automatically include a Learning Adventure subscription unless expressly identified at checkout.

Customers are responsible for reviewing the applicable product description, recommended age information, included materials and product warnings before purchasing or allowing a child to use a product.

SECTION 4: LEARNING ADVENTURES

Altruism Scholars Learning Adventures are educational experiences designed to combine stories, creativity, hands on activities, exploration and meaningful skill development.

Learning Paths may include:

Age ranges associated with Learning Paths are intended as guidance rather than rigid placement requirements.

Every child develops differently. Parents, guardians and Mentors are responsible for selecting the Learning Path they believe is appropriate for their Scholar’s current abilities, interests, confidence, independence and learning needs.

Altruism Scholars does not guarantee that participation in a Learning Adventure will result in any specific academic achievement, grade placement, test result, developmental milestone or educational outcome.

Our educational materials are resources and are not a substitute for individualized professional educational, medical, developmental or therapeutic advice.

Parents, guardians and Mentors remain responsible for determining how Altruism Scholars materials fit within their child’s education and for complying with any homeschool, attendance, reporting, curriculum or other educational requirements applicable in their jurisdiction.

Certain Learning Adventures may include or require a Scholar Profile managed by the Scholar’s Mentor. Scholar Profiles help Altruism Scholars personalize eligible Learning Adventures using preference and learning information provided by the Mentor.

Information requested may include a Scholar’s preferred first name or nickname, age or Scholar Level, Learning Path, current Adventure, interests, favorite colors, themes, characters, preferred activities and other information relevant to personalization.

Mentors are responsible for reviewing the information they provide and confirming that it is accurate before submission.

Personalized preparation cannot begin until all required Scholar Profile information and Mentor confirmation have been received. Mentors should complete requested Scholar Profile information within 48 hours of receiving the request. Late or incomplete submissions may delay processing and fulfillment.

SECTION 5: ORDERS

When you place an order, you are making an offer to purchase.

Altruism Scholars reserves the right to accept, decline, limit or cancel an order where permitted by law, including because of product availability, suspected fraud, pricing or listing errors, payment issues or other circumstances affecting our ability to fulfill the order.

Your order is accepted after payment has been successfully processed and the order has been confirmed.

Please review all product selections, personalization details, colors, styles, Learning Paths, Adventures, shipping information and other customer selected options carefully before completing your purchase.

Once preparation, personalization or fulfillment has begun, changes cannot be guaranteed. Customer submitted errors, including incorrect personalization information or selections, do not constitute an Altruism Scholars fulfillment error.

If we need to cancel or materially modify an order, we will attempt to contact you using the information provided with your purchase.

All sales are final except where otherwise expressly provided in our Return, Replacement & Refund Policy or required by applicable law.

SECTION 6: PRICES, PAYMENT AND BILLING

Prices, promotions and discounts are subject to change without notice.

The price charged will be the price displayed at the time your order is placed, subject to correction of obvious errors where permitted by law.

Unless expressly stated otherwise, displayed product prices do not include applicable taxes, shipping, customs, duties or other charges that may apply to your transaction.

You agree to provide accurate and current payment, billing and account information.

By submitting payment information, you represent that you are authorized to use the selected payment method and authorize applicable charges associated with your purchase.

SECTION 7: SUBSCRIPTIONS AND RECURRING PURCHASES

Certain Altruism Scholars products are offered through automatically renewing subscriptions.

These may include:

Learning Adventures, which may renew every three months according to the subscription selected at checkout.

Create & Play Monthly, which may renew monthly according to the subscription selected at checkout.

The price, billing frequency and other applicable subscription details will be displayed before purchase.

By purchasing an automatically renewing subscription, you authorize recurring charges to your selected payment method at the price and frequency disclosed at checkout, plus applicable taxes and shipping, until the subscription is canceled or otherwise ends.

Subscription pricing may be changed for future billing periods where permitted by law and subject to any notice required by applicable law.

Subscriptions may be managed according to the options available through your customer account and our subscription platform. Available options may include updating payment or shipping information, skipping an upcoming order, pausing, resuming or canceling a subscription.

Cancellation affects future subscription billing and does not automatically cancel, refund or reverse an order that has already been successfully processed, except where required by law or otherwise provided in our policies.

Additional subscription cancellation terms are provided in our Purchase Options Cancellation Policy, which forms part of these Terms.

If a recurring payment fails, additional payment attempts or other actions may occur according to our subscription platform settings and applicable policies.

SECTION 8: DIGITAL CONTENT AND DOWNLOADABLE MATERIALS

Certain purchases may include or provide access to digital materials such as printables, stories, guides, activity pages, planners, worksheets, learning resources or other downloadable content.

Unless expressly stated otherwise, digital content is licensed for personal, noncommercial household use only.

Purchasing or accessing digital content does not transfer ownership of the underlying intellectual property.

You may print or use purchased materials for their intended personal or household purpose. You may not reproduce, resell, redistribute, sublicense, publish, upload, share publicly, commercially reproduce or otherwise exploit our digital materials without prior written permission.

Access to certain digital materials may require an active account, qualifying purchase or active subscription where specified.

SECTION 9: PROCESSING, PREORDERS, SHIPPING AND DELIVERY

Processing time and carrier transit time are separate.

Please allow approximately 2–4 weeks for processing and preparation, depending on the products ordered, personalization requirements and current availability. Some orders may be ready sooner.

When a different processing timeframe is displayed on a product page at the time of purchase, the timeframe provided for that product will apply to that order.

Products identified as preorders are purchased before they are ready for immediate shipment. Unless otherwise stated on the applicable product page, preorder processing and preparation begins after the applicable preorder window closes.

For Learning Adventures requiring a Scholar Profile, personalized preparation cannot begin until the required Scholar Profile information and Mentor confirmation have been received. For preorder Learning Adventures, both the applicable preorder requirement and Scholar Profile requirements must be satisfied before personalized preparation begins.

Processing estimates describe the anticipated time required to prepare an order before transfer to a shipping carrier and do not represent guaranteed delivery dates.

Once an order ships, tracking information will generally be provided when available. Carrier transit times are estimates and are not guaranteed by Altruism Scholars.

We are not responsible for carrier delays, customs delays, severe weather, service interruptions or other circumstances outside our reasonable control, subject to applicable law.

Customers are responsible for providing complete and accurate shipping information. Additional charges resulting from an incorrect, incomplete or undeliverable customer provided address may be the customer’s responsibility where permitted by law.

Additional terms regarding processing, preorders, fulfillment and delivery are provided in our Shipping + Processing Policy, which forms part of these Terms.

SECTION 10: RETURNS, REFUNDS AND CANCELLATIONS

All sales are final except where otherwise expressly provided in our policies or required by applicable law.

We do not offer voluntary returns, exchanges or refunds for change of mind, customer ordering errors, customer submitted personalization errors or other circumstances that are not caused by an Altruism Scholars fulfillment error.

If an order arrives damaged or Altruism Scholars makes a confirmed fulfillment, preparation or personalization error, customers should contact us within 5 calendar days of the carrier confirmed delivery date and follow the requirements provided in our Return, Replacement & Refund Policy.

Personalized, customized, configured, curated, prepared to order and digital products are subject to the specific terms provided in that policy.

Subscription cancellation affects eligible future renewals and does not automatically cancel or refund an order that has already been processed.

Nothing in these Terms limits any nonwaivable consumer rights provided by applicable law.

SECTION 11: CHILD SAFETY AND ADULT SUPERVISION

Parents, guardians and Mentors are responsible for determining whether a product or activity is appropriate for an individual child.

Age recommendations are guidelines and do not replace adult judgment or product specific safety instructions.

Certain products may contain small parts, sensory materials, art materials, craft materials, tools or other components requiring adult supervision.

Customers should review and follow all product labels, instructions, warnings and age recommendations.

Products should not be consumed unless a product is expressly identified as intended for consumption.

Stop use of any material or product if damage, deterioration or another condition makes continued use unsafe.

Adult supervision should be provided whenever appropriate for the child, product and activity.

SECTION 12: INTELLECTUAL PROPERTY

The Services and their contents, including but not limited to Altruism Scholars worlds, characters, stories, artwork, illustrations, Learning Adventures, activities, worksheets, educational frameworks, Mentor materials, product concepts, text, graphics, photographs, videos, designs, logos, trademarks, slogans and other original materials, are owned by or licensed to Altruism Scholars and are protected by applicable intellectual property laws.

This includes original Altruism Scholars creative properties and educational materials made available through physical or digital products.

These Terms permit you to use purchased materials only as expressly authorized for personal, noncommercial purposes.

You may not reproduce, distribute, sell, modify, create derivative commercial works from, publicly display, publish, upload, transmit, scrape, train artificial intelligence systems on, commercially exploit or otherwise use protected Altruism Scholars materials without prior written permission, except where such restriction is prohibited by applicable law.

No purchase transfers ownership of Altruism Scholars intellectual property.

Altruism Scholars names, logos, product names, world names, character names, designs, slogans and other brand identifiers may constitute trademarks or other protected intellectual property and may not be used without authorization.

All rights not expressly granted are reserved.

SECTION 13: OPTIONAL TOOLS AND THIRD PARTY SERVICES

We may provide access to tools, applications, payment services, community platforms or other functionality provided by third parties.

Such third party services may be governed by their own terms and privacy policies.

We do not control third party services and make them available subject to applicable provider terms.

Your use of optional third party tools is at your own discretion and risk.

We may introduce new tools, resources or features in the future. Unless otherwise stated, those features are considered part of the Services and are subject to these Terms.

SECTION 14: THIRD PARTY LINKS

Our Services may contain links to third party websites, products, platforms or resources.

We are not responsible for examining or guaranteeing the accuracy, availability, policies or practices of third party websites or services.

If you leave our Services to access a third party service, your interaction with that third party is governed by its applicable terms and policies.

Questions or complaints regarding third party products or services should be directed to the applicable third party.

SECTION 15: RELATIONSHIP WITH SHOPIFY

Altruism Scholars is powered by Shopify, which enables us to provide the Services to you.

However, any sales and purchases you make in our Store are made directly with Altruism Scholars.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Altruism Scholars, including any injury, damage or loss resulting from purchased products and services.

You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with Altruism Scholars.

SECTION 16: PRIVACY

Personal information collected through our Services is handled according to our Privacy Policy.

Because our Services are hosted by Shopify, Shopify may collect and process personal information relating to your access to and use of the Services to provide and improve its services.

Information may also be processed by service providers used to operate our store, fulfill orders, process payments, manage subscriptions or provide other Services.

Where a Mentor provides information relating to a Scholar for personalization or participation in a Learning Adventure, that information is provided and managed by the adult Mentor. Altruism Scholars does not require Scholars to independently create customer accounts or directly manage online account features intended for Mentors.

Scholar Profile information may be used to personalize eligible Learning Adventures, prepare orders, maintain the Scholar’s Learning Adventure experience and provide related Services as described in our Privacy Policy.

Please review our Privacy Policy for additional information regarding collection, use and disclosure of personal information.

SECTION 17: FEEDBACK, REVIEWS AND USER SUBMISSIONS

If you voluntarily submit reviews, suggestions, feedback, ideas, photographs, comments or other content (“Feedback”), you represent that you have the necessary rights to submit that material.

You grant Altruism Scholars a nonexclusive, worldwide, royalty free license to use, reproduce, publish, display and distribute Feedback for purposes including operating, improving and promoting our Services, subject to applicable law.

You may not submit content that violates another person’s intellectual property, privacy or other rights or that contains unlawful, abusive, defamatory, obscene or malicious material.

You are responsible for the accuracy and legality of the Feedback you submit.

SECTION 18: ERRORS, INACCURACIES AND OMISSIONS

Occasionally information available through our Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, availability, shipping charges, processing times or other information.

We reserve the right to correct errors, update information or cancel affected orders where permitted by law.

SECTION 19: PROHIBITED USES

You may use the Services only for lawful purposes.

You may not use the Services to violate applicable laws or regulations, infringe intellectual property rights, harass or harm others, submit fraudulent information, distribute malicious software, interfere with the security or operation of the Services, impersonate another person or engage in fraudulent or abusive activity.

You may not reproduce, duplicate, copy, scrape, extract, sell, resell or commercially exploit the Services or protected content without authorization.

You may not use automated systems, bots, scraping tools or artificial intelligence agents to systematically access, copy, extract or exploit protected content where such restrictions are permitted by applicable law.

We reserve the right to restrict or terminate access when we reasonably determine that these Terms have been violated.

SECTION 20: AGENTS AND AUTOMATED SYSTEMS

If an automated or semi automated agent accesses or interacts with our Services, it must comply with applicable laws, these Terms and any technical restrictions implemented by Altruism Scholars or Shopify.

Automated systems may not conceal their automated nature, circumvent access restrictions, bypass security measures or defeat systems designed to distinguish automated access from human use.

We may restrict or block automated access to the Services where permitted by law.

SECTION 21: TERMINATION

We may suspend or terminate access to some or all of the Services where permitted by law if these Terms are violated, fraudulent or abusive activity is suspected, or continued access could harm Altruism Scholars, Shopify, our customers or third parties.

Termination does not eliminate payment obligations incurred before termination.

Provisions that by their nature should survive termination, including intellectual property, payment obligations, disclaimers, limitations of liability and indemnification provisions, will continue to apply.

SECTION 22: DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, the Services and products are provided “as is” and “as available,” except for any express warranties provided by Altruism Scholars or warranties that cannot legally be excluded.

We do not guarantee that access to the Services will always be uninterrupted, secure or error free.

Educational materials and experiences are designed to support learning, creativity, curiosity and exploration, but individual experiences and outcomes vary.

Nothing in these Terms excludes warranties, guarantees or consumer rights that cannot lawfully be excluded.

SECTION 23: LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ALTRUISM SCHOLARS AND ITS AFFILIATES, PARTNERS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES OR PRODUCTS.

THE FOREGOING DOES NOT EXCLUDE OR LIMIT LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

Nothing in these Terms is intended to waive rights or remedies provided to consumers that cannot legally be waived.

SECTION 24: INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless Altruism Scholars, Shopify and their respective affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from third party claims, damages, liabilities and reasonable costs arising from your material breach of these Terms, your violation of applicable law or your violation of the rights of another person.

SECTION 25: SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be enforced to the fullest extent permitted by law or severed where necessary.

The remaining provisions will continue in full force and effect.

SECTION 26: WAIVER AND ENTIRE AGREEMENT

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.

These Terms and any policies incorporated by reference constitute the agreement between you and Altruism Scholars regarding your use of the Services, subject to any additional terms presented with a particular product, promotion or purchase.

SECTION 27: ASSIGNMENT

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

We may assign or transfer our rights and obligations where permitted by law.

SECTION 28: GOVERNING LAW

These Terms and any separate agreements through which we provide Services will be governed by the laws applicable in the jurisdiction in which Altruism Scholars is headquartered, without limiting any mandatory consumer protections that apply to you under applicable law.

Any disputes will be handled in courts having lawful jurisdiction over the dispute unless applicable law requires otherwise.

Section headings are provided for convenience and do not limit or otherwise affect the interpretation of these Terms.

The most current version of these Terms will be available on this page.

We may update these Terms periodically to reflect changes to our Services, products, business practices or legal obligations.

When required by applicable law, we will provide notice of material changes.

Changes become effective as stated in the applicable notice or when posted where permitted by law.
